       Senator Hays moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 430 - 448
    4  and insert:
    5         (5) It is the public policy of this state that prior to
    6  transition of homeowners’ association control in a community
    7  from the developer to the nondeveloper members, as provided
    8  under s. 720.307, a developer is prohibited from unilaterally
    9  making amendments to the governing documents which are
   10  arbitrary, capricious, or in bad faith or which unreasonably
   11  modify the original plan of development, prejudice the rights of
   12  the existing nondeveloper members to use and enjoy the benefits
   13  of the common property, or materially shift economic burdens
   14  from the developer to the existing nondeveloper members.
