       The Committee on Judiciary (Joyner) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete line 50
    4  and insert:
    5         (5) When a law enforcement officer issues a citation for a
    6  violation of this section, the law enforcement officer must
    7  record the race and ethnicity of the violator. All law
    8  enforcement agencies must maintain such information and forward
    9  the information to the department in a form and manner
   10  determined by the department. The department shall collect this
   11  information by jurisdiction and annually report the data to the
   12  Governor, the President of the Senate, and the Speaker of the
   13  House of Representatives. The report must show separate
   14  statewide totals for the state’s county sheriffs and municipal
   15  law enforcement agencies, state law enforcement agencies, and
   16  state university law enforcement agencies.
   17         (6)(5) A violation of this section is a noncriminal traffic

   20         And the title is amended as follows:
   21         Delete line 9
   22  and insert:
   23         where such soundmaking devices may be operated;
   24         requiring law enforcement officers to record the race
   25         and ethnicity of violators and forward the information
   26         to the Department Of Highway Safety And Motor
   27         Vehicles; requiring the department to annually report
   28         such information to the Governor, the President of the
   29         Senate, and the Speaker of the House of
   30         Representatives;
