    1                        A bill to be entitled                      
    2         An act relating to wine; amending s. 564.05, F.S.;
    3         providing an exception to the maximum allowable
    4         capacity for individual containers of wine sold in
    5         this state; providing that, except as provided in s.
    6         564.09, F.S., all wine containers sold or offered for
    7         sale at retail for consumption off the premises shall
    8         be in the original container; providing an effective
    9         date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 564.05, Florida Statutes, is amended to
   14  read:
   15         564.05 Limitation of size of individual wine containers;
   16  penalty.—It is unlawful for any person to sell within this state
   17  any wine in individual containers holding more than 1 gallon of
   18  such wine unless such wine is in reusable containers holding
   19  5.16 gallons. However, Provided, that qualified distributors and
   20  manufacturers may sell to other qualified distributors or
   21  manufacturers such wine in any size containers. Except as
   22  provided in s. 564.09, all wine sold or offered for sale by
   23  licensed vendors to be consumed off the premises shall be in the
   24  unopened original container. Any person convicted of a violation
   25  of this section commits shall be guilty of a misdemeanor of the
   26  second degree, punishable as provided in s. 775.082 or s.
   27  775.083.
   28         Section 2. This act shall take effect July 1, 2013.
