       The Committee on Banking and Insurance (Simmons) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 614 - 621
    4  and insert:
    5         (2) In those counties in which the office has determined
    6  there is not a reasonable degree of competition, an insurer may
    7  not use excess rates authorized under pursuant to this section
    8  for more than 10 percent of its commercial insurance policies
    9  written or renewed in each calendar year for any line of
   10  commercial insurance or for more than 5 percent of its personal
   11  lines insurance policies written or renewed in each calendar
   12  year for any line of personal insurance. In determining
