1 A bill to be entitled
2 An act relating to ratification of rules implementing
3 total maximum daily loads for impaired water bodies;
4 ratifying specified rules of the Department of
5 Environmental Protection for the sole and exclusive
6 purpose of satisfying any condition on effectiveness
7 pursuant to s. 120.541(3), F.S., which requires
8 ratification of any rule meeting any of the specified
9 thresholds for likely adverse impact or increase in
10 regulatory costs; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. (1) The following rules are ratified for the
15 sole and exclusive purpose of satisfying any condition on
16 effectiveness imposed under s. 120.541(3), Florida Statutes:
17 (a) Subsections (3) through (7) of rule 62-304.300, Florida
18 Administrative Code, entitled “St. Marks River Basin TMDLs,”
19 relating to total maximum daily loads for impaired water bodies
20 within the St. Marks River Basin, as filed for adoption with the
21 Department of State pursuant to the certification package dated
22 March 2, 2012.
23 (b) Subsections (10) and (11) of rule 62-304.330, Florida
24 Administrative Code, entitled “Pensacola Bay Basin TMDLs,”
25 relating to total maximum daily loads for impaired water bodies
26 within the Pensacola Bay Basin, as filed for adoption with the
27 Department of State pursuant to the certification package dated
28 February 7, 2013.
29 (c) Subsections (14) through (20) of rule 62-304.520,
30 Florida Administrative Code, entitled “Indian River Lagoon Basin
31 TMDLs,” relating to total maximum daily loads for impaired water
32 bodies within the Indian River Lagoon, as filed for adoption
33 with the Department of State pursuant to the certification
34 package dated March 20, 2013.
35 (d) Subsection (12) of rule 62-304.610, Florida
36 Administrative Code, entitled “Hillsborough River Basin TMDLs,”
37 relating to total maximum daily loads for impaired water bodies
38 within the Hillsborough River Basin, as filed for adoption with
39 the Department of State pursuant to the certification package
40 dated August 20, 2012, and as further corrected by the letter
41 from the Department of Environmental Protection to the
42 Department of State dated February 13, 2013.
43 (e) Subsections (13) and (14) of rule 62-304.645, Florida
44 Administrative Code, entitled “Springs Coast Basin TMDLs,”
45 relating to total maximum daily loads for impaired water bodies
46 within the Springs Coast Basin, as filed for adoption with the
47 Department of State pursuant to the certification package dated
48 March 8, 2013.
49 (f) Rule 62-304.900, Florida Administrative Code, entitled
50 “Statewide TMDLs,” relating to a statewide total daily maximum
51 load for mercury-impaired water bodies within the state, as
52 filed for adoption with the Department of State pursuant to the
53 certification package dated November 21, 2012.
54 (2) This act serves no other purpose and shall not be
55 codified in the Florida Statutes. After this act becomes law,
56 its enactment and effective dates shall be noted in the Florida
57 Administrative Code or the Florida Administrative Register or
58 both, as appropriate. This act does not alter rulemaking
59 authority delegated by prior law, does not constitute
60 legislative preemption of or exception to any provision of law
61 governing adoption or enforcement of the rules cited, and is
62 intended to preserve the status of any cited rule as a rule
63 under chapter 120, Florida Statutes. This act does not cure any
64 rulemaking defect or preempt any challenge based on a lack of
65 authority or a violation of the legal requirements governing the
66 adoption of any rule cited.
67 Section 2. This act shall take effect upon becoming a law.
