       The Committee on Appropriations (Galvano) recommended the
       following:
       
    1         Senate Amendment (with directory and title amendments)
    2  
    3         Between lines 52 and 53
    4  insert:
    5         (7) PREEMPTION AUTHORITY.—
    6         (a) The regulation of public lodging establishments and
    7  public food service establishments, including, but not limited
    8  to, sanitation standards, inspections, training and testing of
    9  personnel, and matters related to the nutritional content and
   10  marketing of foods offered in such establishments, is preempted
   11  to the state. This paragraph does not preempt the authority of a
   12  local government or local enforcement district to conduct
   13  inspections of public lodging and public food service
   14  establishments for compliance with the Florida Building Code and
   15  the Florida Fire Prevention Code, pursuant to ss. 553.80 and
   16  633.022.
   17         (b) A local law, ordinance, or regulation may not restrict
   18  the use of vacation rentals, prohibit vacation rentals, or
   19  regulate vacation rentals based solely on their classification,
   20  use, or occupancy. This paragraph does not apply to any local
   21  law, ordinance, or regulation adopted on or before June 1, 2011.
   22         (c) Paragraph (b) does not apply to any local law,
   23  ordinance, or regulation exclusively relating to property
   24  valuation as a criterion for vacation rental if the local law,
   25  ordinance, or regulation is required to be approved by the state
   26  land planning agency pursuant to an area of critical state
   27  concern designation.

   30         And the directory clause is amended as follows:
   31         Delete lines 12 - 13
   32  and insert:
   33         Section 1. Paragraph (a) of subsection (2) and subsection
   34  (7) of section 509.032, Florida Statutes, are amended to read:
   35

   37         And the title is amended as follows:
   38         Delete line 8
   39  and insert:
   40         terminology; deleting a provision that a local law,
   41         ordinance, or regulation may not restrict the use of
   42         vacation rentals, prohibit vacation rentals, or
   43         regulate vacation rentals based on the classification
   44         use or occupancy; deleting the exception to that
   45         provision; providing an effective date.
