       Senator Diaz de la Portilla moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 49 - 67
    4  and insert:
    5         255.60 Special contracts with charitable or not-for-profit
    6  youth organizations.—The state, or the governing body of any
    7  political subdivision of the state, or a public-private
    8  partnership is authorized, but not required, to contract for
    9  public service work with a not-for-profit organization or
   10  charitable youth organization such as highway and park
   11  maintenance, notwithstanding competitive sealed bid procedures
   12  required under this chapter, or chapter 287, or any municipal or
   13  county charter, upon compliance with this section.
   14         (1) The contractor or supplier must meet the following
   15  conditions:
   16         (a) The contractor or supplier must be a not-for-profit
   17  corporation incorporated under chapter 617 and in good standing.
   18         (b) The contractor or supplier must hold exempt status
   19  under s. 501(a) of the Internal Revenue Code, as an organization
   20  described in s. 501(c)(3) of the Internal Revenue Code.
   21         (c) For youth organizations, the corporate charter of the
   22  contractor or supplier must state that the corporation is
   23  organized as a charitable not-for-profit youth organization
   24  exclusively for at-
