1 A bill to be entitled
2 An act relating to the sale of liquid fuels; amending
3 s. 526.141, F.S.; requiring self-service stations to
4 display on each pump a decal containing a telephone
5 number to enable certain handicapped persons to seek
6 assistance from the station attendant; requiring the
7 Department of Agriculture and Consumer Services to
8 provide decals and instructions; providing for
9 enforcement by the department; providing for the
10 adoption of rules; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (3) of section 526.141, Florida
15 Statutes, is amended to read:
16 526.141 Self-service gasoline stations; attendants;
17 regulations.—
18 (3) All self-service gasoline stations must shall have at
19 least one attendant on duty while the station is open to the
20 public. The attendant on duty shall be mentally and physically
21 capable of performing the functions and assuming the
22 responsibilities prescribed in this subsection.
23 (a) The attendant’s primary function shall be the proper
24 administration, supervision, observation, and control of the
25 dispensing of flammable and combustible liquids used as motor
26 fuels while such liquids are actually being dispensed. It shall
27 be the responsibility of The attendant shall to prevent the
28 dispensing of flammable and combustible liquids used as motor
29 fuels into portable containers unless such container bears a
30 seal of approval of a nationally recognized testing agency; to
31 control sources of ignition; and immediately to handle
32 accidental spills and fire extinguishers if needed. The
33 attendant on duty shall be mentally and physically capable of
34 performing the functions and assuming the responsibility
35 prescribed in this subsection.
36 (b) Such stations shall also display on each pump a decal
37 bearing a telephone number to call the attendant to enable the
38 operator of a motor vehicle that displays an exemption parking
39 permit as provided in s. 316.1958 or s. 320.0848 or a license
40 plate issued pursuant to s. 320.084, s. 320.0842, s. 320.0843,
41 or s. 320.0845 to request service or assistance. The decal must
42 be prominently displayed on the front of each self-service pump
43 and near the inspection decal and must contain a blank space
44 upon which the telephone number can be written. The Department
45 of Agriculture and Consumer Services, when inspecting a station,
46 shall apply the decals to the pumps and provide instructions to
47 the operator for displaying the decals and complying with this
48 paragraph. The department shall enforce this subsection and
49 shall adopt rules to administer this subsection.
50 Section 2. This act shall take effect July 1, 2013.
