       The Committee on Criminal Justice (Smith) recommended the
       following:
       
    1         Senate Substitute for Amendment (816222) (with title
    2  amendment)

    6         Delete lines 32 - 36
    7  and insert:
    8         (4) EXCEPTIONS.—This act does not prohibit the use of a
    9  drone:
   10         (a) To counter a high risk of a terrorist attack by a
   11  specific individual or organization if the United States
   12  Secretary of Homeland Security determines that credible
   13  intelligence indicates that there is such a risk.
   14         (b) If the law enforcement agency first obtains a search
   15  warrant signed by a judge authorizing the use of a drone.
   16         (c) If the law enforcement agency possesses reasonable
   17  suspicion that under particular circumstances, swift action is
   18  needed to prevent imminent danger to life or serious damage to
   19  property, or to forestall the imminent escape of a suspect or
   20  the destruction of evidence.

   25  and insert:
