Senator Garcia moved the following:
1 Senate Amendment to Amendment (864338) (with title

4 Delete lines 5 - 22
5 and insert:
6 Section 87. Section 456.60, Florida Statutes, is created to
7 read:
8 456.60 Standards for telemedicine; rulemaking authority;
9 requirements.—On or before March 31, 2014, the Board of Medicine
10 shall adopt rules for physicians licensed under chapter 458
11 which allows the provision of health care services to patients
12 within the state via telemedicine by Florida-licensed health
13 care practitioners.
14 (1) The rules for telemedicine services must include, but
15 need not be limited to, the use of interactive audio, video,
16 secure chat, secure email, electronic media, or telephone for
17 the practice of health care delivery, diagnosis, consultation,
18 treatment, transfer of medical data, or exchange of medical
19 education information by a health care provider to deliver
20 health care services at a site other than the site of the
21 patient’s location.
22 (2) The rules for telemedicine services must provide
23 requirements for the following:
24 (a) Licensure for the provision of telemedicine services;
25 (b) Standard of care requirements for health care
26 practitioners practicing telemedicine which are the same
27 standard of care requirements applicable to practitioners
28 practicing in other care settings; and
29 (c) Conducting patient evaluations and prescribing legend
30 drugs, other than controlled substances, via telemedicine.

35 and insert:
