    1         Senate Amendment (with title amendment)

    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Paragraph (k) is added to subsection (5) of
    6  section 400.93, Florida Statutes, is to read:
    7         400.93 Licensure required; exemptions; unlawful acts;
    8  penalties.—
    9         (5) The following are exempt from home medical equipment
   10  provider licensure, unless they have a separate company,
   11  corporation, or division that is in the business of providing
   12  home medical equipment and services for sale or rent to
   13  consumers at their regular or temporary place of residence
   14  pursuant to the provisions of this part:
   15         (k) Physicians licensed pursuant to chapter 458, chapter
   16  459, or chapter 460 for the sale or rental of electrostimulation
   17  medical equipment and electrostimulation medical equipment
   18  supplies to their patients in the course of their practice.
   19         Section 2. This act shall take effect July 1, 2014.

   22  And the title is amended as follows:
   23         Delete everything before the enacting clause
   24  and insert:
   25                        A bill to be entitled                      
   26         An act relating to home medical equipment; amending
   27         section 400.93; exempting allopathic, osteopathic, and
   28         chiropractic physicians who sell or rent
   29         electrostimulation medical equipment and supplies to
   30         their patients in the course of their practice from
   31         licensure as home medical equipment providers;
   32         providing an effective date.
