       Senator Garcia moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Before line 52
    4  insert:
    5         Section 1. Paragraph (f) of subsection (5) of section
    6  400.235, Florida Statutes, is amended to read:
    7         400.235 Nursing home quality and licensure status; Gold
    8  Seal Program.—
    9         (5) Facilities must meet the following additional criteria
   10  for recognition as a Gold Seal Program facility:
   11         (f) Had no evidence of unresolved, verified complaints
   12  generated through an outstanding record regarding the number and
   13  types of substantiated complaints reported to the State Long
   14  Term Care Ombudsman Program Council within the 30 months
   15  preceding application for the program.

   17  A facility assigned a conditional licensure status may not
   18  qualify for consideration for the Gold Seal Program until after
   19  it has operated for 30 months with no class I or class II
   20  deficiencies and has completed a regularly scheduled relicensure
   21  survey.
