       Senator Clemens moved the following:
    1         Senate Amendment (with title amendment)
    3         Between lines 87 and 88
    4  insert:
    5         Section 2. Subsections (3) through (5) of section 316.081,
    6  Florida Statutes, are amended to read:
    7         316.081 Driving on right side of roadway; exceptions.—
    8         (3) On a road, street, or highway having two or more lanes
    9  allowing movement in the same direction, a driver may not
   10  continue to operate a motor vehicle at any speed which is more
   11  than 10 miles per hour slower than the posted speed limit in the
   12  furthermost left-hand lane if the driver knows or reasonably
   13  should know that he or she is being overtaken in that lane from
   14  the rear by a motor vehicle traveling at a higher rate of speed.
   15  This subsection does not apply to drivers operating a vehicle
   16  that is overtaking another vehicle proceeding in the same
   17  direction, or is preparing for a left turn at an intersection.
   18         (3)(4) Upon any roadway having four or more lanes for
   19  moving traffic and providing for two-way movement of traffic, no
   20  vehicle shall be driven to the left of the centerline of the
   21  roadway, except when authorized by official traffic control
   22  devices designating certain lanes to the left side of the center
   23  of the roadway for use by traffic not otherwise permitted to use
   24  such lanes, or except as permitted under paragraph (1)(b).
   25  However, this subsection shall not be construed as prohibiting
   26  the crossing of the centerline in making a left turn into or
   27  from an alley, private road, or driveway.
   28         (4)(5) A violation of this section is a noncriminal traffic
   29  infraction, punishable as a moving violation as provided in
   30  chapter 318.
