2 An act relating to state lotteries; creating s.
3 24.132, F.S.; offering a special instant scratch-off
4 lottery game entitled “Ticket for the Cure” by the
5 Department of the Lottery; providing for revenues to
6 be used for the purpose of funding breast cancer
7 research and services for certain breast cancer
8 victims; providing restrictions for the use of funds;
9 defining the terms “net revenue” and “research”;
10 authorizing the department to adopt rules; amending s.
11 24.121, F.S.; providing for revenues to be equitably
12 apportioned to certain state universities to be used
13 for the purpose of funding breast cancer research and
14 services for certain breast cancer victims; providing
15 an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Section 24.132, Florida Statutes, is created to
20 read:
21 24.132 Ticket for the Cure.—
22 (1) The department shall offer a special instant scratch
23 off lottery game with the title “Ticket for the Cure.” The game
24 shall commence on January 1, 2015, and shall be discontinued on
25 December 31, 2020. During the time that tickets are sold for the
26 Ticket for the Cure game, the department may not unreasonably
27 diminish the efforts devoted to marketing any other instant
28 scratch-off lottery game.
29 (2) As used in this section, the term:
30 (a) “Net revenue” means the total amount for which tickets
31 have been sold less the sum of the amount paid out in prizes and
32 the actual administrative expenses of the department solely
33 related to the Ticket for the Cure game.
34 (b) “Research” includes, but is not limited to,
35 expenditures to develop and advance the understanding,
36 techniques, and modalities effective in the detection,
37 screening, prevention, and treatment of breast cancer, including
38 clinical trials.
39 (3) The net revenue from the Ticket for the Cure scratch
40 off game shall be allocated pursuant to s. 24.121(5)(f), to be
41 used for the purpose of funding breast cancer research and
42 services for low-income, uninsured breast cancer victims. The
43 funds may not be used for institutional, organizational, or
44 community-based overhead costs, indirect costs, or levies.
45 (4) The department may adopt rules to administer this
46 section.
47 Section 2. Paragraph (b) of subsection (5) of section
48 24.121, Florida Statutes, is amended, present paragraph (f) of
49 that subsection is redesignated as paragraph (g), and a new
50 paragraph (f) is added to that subsection, to read:
51 24.121 Allocation of revenues and expenditure of funds for
52 public education.—

54 (b) Except as provided in paragraphs (c), (d), and (e), and
55 (f), the Legislature shall equitably apportion moneys in the
56 trust fund among public schools, community colleges, and
57 universities.
58 (f) The net revenues received under s. 24.132 shall be
59 equitably apportioned to state universities that have medical
60 research facilities or that are associated with medical research
61 facilities. The moneys shall be used for the purpose of funding
62 breast cancer research and services under s. 24.132 for low
63 income, uninsured breast cancer victims.
64 Section 3. This act shall take effect July 1, 2014.
