Section 551.079, Florida Statutes, is created 6 to read: 7 551.079 Advance deposit wagering.— 8 (1) As used in this section, the term: 9 (a) “Advance deposit wagering” means a form of pari-mutuel 10 wagering in which an individual deposits money into an account 11 with a person authorized by the department to conduct advance 12 deposit wagering and such individual uses the account funds to 13 pay for pari-mutuel wagers made in person, by telephone, or 14 through communication by other electronic means. 15 (b) “Permitholder” means a person that is issued a permit 16 under this part. 17 (2) The department may authorize advance deposit wagering 18 conducted by: 19 (a) A permitholder; or 20 (b) An operator of an advance deposit wagering system 21 accepting wagers pursuant to an agreement with a permitholder if 22 the agreement is approved by the department. 23 (3) A person authorized to conduct advance deposit wagering 24 under subsection (2) may accept advance deposit wagering for: 25 (a) Races or games conducted in this state under a permit 26 issued under this part; or 27 (b) Races or games conducted in another state on a schedule 28 approved by the permitholder. 29 (4) Residents of this state may not place wagers through a 30 system of advance deposit wagering except with a person 31 authorized to conduct advance deposit wagering under subsection 32 (2). Only persons authorized to conduct advance deposit wagering 33 under subsection (2) may accept wagers from residents of this 34 state. 35 (5) A person authorized to conduct advance deposit wagering 36 under subsection (2) may not: 37 (a) Accept an account wager in an amount in excess of the 38 funds on deposit in the advance deposit wagering account of the 39 individual placing the wager; or 40 (b) Allow individuals younger than 21 years of age to open, 41 own, or have access to an advance deposit wagering account. 42 (6) A person authorized to conduct advance deposit wagering 43 under subsection (2) must: 44 (a) Include a statement in all forms of advertising for 45 advance deposit wagering that individuals younger than 21 years 46 of age are not allowed to open, own, or have access to an 47 advance deposit wagering account; and 48 (b) Verify the identification, residence, and age of the 49 advance deposit wagering account holder using methods and 50 technologies approved by the department. 51 (7) Wagers placed pursuant to this section shall be taxed 52 at the same rate and in the same manner as wagers placed on 53 simulcasting under this part. 54 (8) The department shall adopt rules to administer this 55 section. 56 57 ================= T I T L E A M E N D M E N T ================ 58 And the title is amended as follows: 59 Delete line 117 60 and insert: 61 limited licensure, and totalisators; creating s. 62 551.079, F.S.; defining terms; authorizing the 63 department to authorize advance deposit wagering 64 conducted by certain permitholders or certain 65 operators contracting with a permitholder; specifying 66 requirements for a person authorized to conduct 67 advance deposit wagering; imposing a tax on advanced 68 deposit wagers; requiring the department to adopt 69 rules; creating s.
