    1                        A bill to be entitled                      
    2         An act relating to trust funds; amending s. 20.1971,
    3         F.S.; creating the Grants and Donations Trust Fund
    4         within the Agency for Persons with Disabilities;
    5         providing for annual carryforward of funds; providing
    6         for future review and termination or re-creation of
    7         the trust fund; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (6) is added to section 20.1971,
   12  Florida Statutes, to read:
   13         20.1971 Agency for Persons with Disabilities; trust funds.
   14  The following trust funds shall be administered by the Agency
   15  for Persons with Disabilities:
   16         (6) Grants and Donations Trust Fund.
   17         (a) The Grants and Donations Trust Fund is created within
   18  the agency and established for use as a depository for funds
   19  from grants or donations, or cash income received from the
   20  disposal of such donations, received by the agency.
   21         (b) Funds to be credited to and uses of the trust fund
   22  shall be administered in accordance with s. 215.32.
   23         (c) Notwithstanding s. 216.301 and pursuant to s. 216.351,
   24  any balance in the trust fund at the end of any fiscal year
   25  shall remain in the trust fund at the end of the year and shall
   26  be available for carrying out the purposes of the trust fund.
   27         (d) In accordance with s. 19(f)(2), Art. III of the State
   28  Constitution, the Grants and Donations Trust Fund shall, unless
   29  terminated earlier, be terminated on July 1, 2018. Before its
   30  scheduled termination, the trust fund shall be reviewed as
   31  provided in s. 215.3206(1) and (2).
   32         Section 2. This act shall take effect July 1, 2014.
