1 A bill to be entitled
2 An act relating to a review under the Open Government
3 Sunset Review Act; amending s. 288.985, F.S., which
4 provides exemptions from public records and public
5 meetings requirements for certain records and meetings
6 of the Florida Defense Support Task Force; saving the
7 exemptions from repeal under the Open Government
8 Sunset Review Act; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 288.985, Florida Statutes, is amended to
13 read:
14 288.985 Exemptions from public records and public meetings
15 requirements.—
16 (1) The following records held by the Florida Defense
17 Support Task Force are exempt from s. 119.07(1) and s. 24(a),
18 Art. I of the State Constitution:
19 (a) That portion of a record which relates to strengths and
20 weaknesses of military installations or military missions in
21 this state relative to the selection criteria for the
22 realignment and closure of military bases and missions under any
23 United States Department of Defense base realignment and closure
24 process.
25 (b) That portion of a record which relates to strengths and
26 weaknesses of military installations or military missions in
27 other states or territories and the vulnerability of such
28 installations or missions to base realignment or closure under
29 the United States Department of Defense base realignment and
30 closure process, and any agreements or proposals to relocate or
31 realign military units and missions from other states or
32 territories.
33 (c) That portion of a record which relates to the state’s
34 strategy to retain its military bases during any United States
35 Department of Defense base realignment and closure process and
36 any agreements or proposals to relocate or realign military
37 units and missions.
38 (2) Meetings or portions of meetings of the Florida Defense
39 Support Task Force, or a workgroup of the task force, at which
40 records are presented or discussed which are exempt under
41 subsection (1) are exempt from s. 286.011 and s. 24(b), Art. I
42 of the State Constitution.
43 (3) Any records generated during those portions of meetings
44 which are closed to the public under subsection (2), including,
45 but not limited to, minutes, tape recordings, videotapes,
46 digital recordings, transcriptions, or notes, are exempt from s.
47 119.07(1) and s. 24(a), Art. I of the State Constitution.
48 (4) Any person who willfully and knowingly violates this
49 section commits a misdemeanor of the first degree, punishable as
50 provided in s. 775.082 or s. 775.083.
51 (5) This section is subject to the Open Government Sunset
52 Review Act in accordance with s. 119.15 and shall stand repealed
53 on October 2, 2014, unless reviewed and saved from repeal
54 through reenactment by the Legislature.
55 Section 2. This act shall take effect October 1, 2014.
