The Committee on Appropriations (Bean) recommended the
following:

4 insert:
5 Section 2. Subsection (3) of section 258.007, Florida
6 Statutes, is amended to read:
7 258.007 Powers of division.—
8 (3)(a) The division may grant privileges, leases,
9 concessions, and permits for the use of land for the
10 accommodation of visitors in the various parks, monuments, and
11 memorials, provided no natural curiosities or objects of
12 interest shall be granted, leased, or rented on such terms as
13 shall deny or interfere with free access to them by the public;
14 provided further, such grants, leases, and permits may be made
15 and given without advertisement or securing competitive bids;
16 and provided further, that no such grant, lease, or permit shall
17 be assigned or transferred by any grantee without consent of the
18 division.
19 (b) Notwithstanding paragraph (a), after May 1, 2014, the
20 division may not grant new concession agreements for the
21 accommodation of visitors in a state park that provides beach
22 access and contains less than 7000 linear feet of shoreline if
23 the type of concession is available within 1500 feet of the
24 park’s boundaries. This paragraph does not apply to concession
25 agreements for accommodations offered at the park on or before
26 May 1, 2014. This paragraph shall take effect upon this act
27 becoming a law.

30 And the title is amended as follows:
31 Delete lines 6 through 19
32 and insert:
33 rules; amending s. 258.007, F.S., prohibiting certain
34 new concession agreements in state parks with limited
35 shorelines; exempting existing accommodations;
36 creating s. 258.435, F.S., requiring the department to
37 promote the public use of aquatic preserves and their
38 associated uplands; authorizing the department to
39 receive gifts and donations for certain purposes;
40 authorizing the department to grant privileges or
41 concessions for the accommodation of visitors in and
42 use of aquatic preserves and their associated uplands
43 provided certain conditions are met; prohibiting a
44 grantee from assigning or transferring such privileges
45 or concessions without the department’s consent;
46 requiring information on proposed concession
47 agreements to be posted on the department’s website
48 upon submittal and 60 days before execution; providing
49 effective dates.
