    1                        A bill to be entitled                      
    2         An act relating to registration of melon hauling
    3         vehicles; amending s. 320.08, F.S.; providing a fee
    4         for registration of a melon hauling vehicle; defining
    5         the term “melon hauling vehicle”; amending s. 322.53,
    6         F.S.; exempting drivers of melon hauling vehicles from
    7         the requirement to obtain a commercial driver license;
    8         requiring such drivers to comply with specified
    9         regulations; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Paragraph (f) is added to subsection (3) of
   14  section 320.08, Florida Statutes, to read:
   15         320.08 License taxes.—Except as otherwise provided herein,
   16  there are hereby levied and imposed annual license taxes for the
   17  operation of motor vehicles, mopeds, motorized bicycles as
   18  defined in s. 316.003(2), tri-vehicles as defined in s. 316.003,
   19  and mobile homes, as defined in s. 320.01, which shall be paid
   20  to and collected by the department or its agent upon the
   21  registration or renewal of registration of the following:
   22         (3) TRUCKS.—
   23         (f) A melon hauling vehicle: $7.50 flat. The term “melon
   24  hauling vehicle” means a vehicle that has been altered from its
   25  original use so that the primary purpose is to transport melons
   26  from a farm or harvest place to the first place of processing or
   27  storage, or from a farm or harvest place directly to market.
   28         Section 2. Paragraph (c) of subsection (2) of section
   29  322.53, Florida Statutes, is amended to read:
   30         322.53 License required; exemptions.—
   31         (2) The following persons are exempt from the requirement
   32  to obtain a commercial driver license:
   33         (c)1. Farmers transporting agricultural products, farm
   34  supplies, or farm machinery to or from their farms and within
   35  150 miles of their farms, if the vehicle operated under this
   36  exemption is not used in the operations of a common or contract
   37  motor carrier.
   38         2. Drivers of melon hauling vehicles registered under s.
   39  320.08(3)(f). However, such drivers must comply with 49 C.F.R.
   40  parts 382, 392, and 393 and 49 C.F.R. ss. 396.3(a)(1) and 396.9.
   41         Section 3. This act shall take effect July 1, 2015.
