    1                        A bill to be entitled                      
    2         An act relating to liquid nitrogen; creating ss.
    3         509.055 and 562.457, F.S.; defining terms; requiring
    4         public service establishments and certain
    5         establishments licensed under the Beverage Law,
    6         respectively, to advise and train their employees in
    7         the use of liquid nitrogen; setting minimum standards
    8         for liquid nitrogen training; requiring such
    9         establishments to provide notice to their guests
   10         regarding the danger of liquid nitrogen; providing an
   11         effective date.
   12          
   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Section 509.055, Florida Statutes, is created to
   16  read:
   17         509.055 Regulating the use of liquid nitrogen in food.—
   18         (1) As used in this section, the term:
   19         (a) “Inadequately ventilated area” means an atmosphere at a
   20  temperature causing liquid nitrogen to warm and become a gas
   21  that displaces the oxygen in the atmosphere.
   22         (b) “Liquid nitrogen” means the liquid form of the gas
   23  known as nitrogen, existing in its liquid state at or below
   24  approximately -320 degrees Fahrenheit.
   25         (2) Public service establishments must advise their
   26  employees of the danger associated with using liquid nitrogen in
   27  preparing food and must train their employees who use liquid
   28  nitrogen to prepare food to take appropriate precautions. Such
   29  precautions include, but are not limited to:
   30         (a) Not using liquid nitrogen in an enclosed or
   31  inadequately ventilated area;
   32         (b) Using proper containers and devices to trap liquid
   33  nitrogen; and
   34         (c) Ensuring that any liquid nitrogen used to prepare food
   35  fully evaporates before the food is served to a guest.
   36         (3) Public service establishments serving food that was
   37  prepared with liquid nitrogen must notify a guest before he or
   38  she is served of the danger associated with consuming liquid
   39  nitrogen.
   40         Section 2. Section 562.457, Florida Statutes, is created to
   41  read:
   42         562.457 Regulating the use of liquid nitrogen in alcoholic
   43  beverages.—
   44         (1) As used in this section, the term:
   45         (a) “Inadequately ventilated area” means an atmosphere at a
   46  temperature causing liquid nitrogen to warm and become a gas
   47  that displaces the oxygen in the atmosphere.
   48         (b) “Liquid nitrogen” means the liquid form of the gas
   49  known as nitrogen, existing in its liquid state at or below
   50  approximately -320 degrees Fahrenheit.
   51         (2) Establishments licensed to sell or serve alcoholic
   52  beverages for consumption on the premises must advise their
   53  employees of the danger associated with using liquid nitrogen in
   54  preparing alcoholic beverages and must train their employees who
   55  use liquid nitrogen to prepare alcoholic beverages to take
   56  appropriate precautions. Such precautions include, but are not
   57  limited to:
   58         (a) Not using liquid nitrogen in an enclosed or
   59  inadequately ventilated area;
   60         (b) Using proper containers and devices to trap liquid
   61  nitrogen; and
   62         (c) Ensuring that any liquid nitrogen used to prepare an
   63  alcoholic beverage fully evaporates before the beverage is
   64  served to a customer.
   65         (3) Licensees that serve alcoholic beverages prepared with
   66  liquid nitrogen must notify a customer before he or she is
   67  served of the danger associated with consuming liquid nitrogen.
   68         Section 3. This act shall take effect July 1, 2015.
