    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 766.412,
    3         F.S.; creating the Patient Compensation System Trust
    4         Fund within the State Treasury; providing the purpose
    5         of the trust fund; providing for future review and
    6         termination or re-creation of the trust fund;
    7         providing a contingent effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 766.412, Florida Statutes, is created to
   12  read:
   13         766.412Patient Compensation System Trust Fund.—
   14         (1) There is created in the State Treasury a special fund
   15  to be designated as the “Patient Compensation System Trust
   16  Fund,” which shall be used in the operation of the Patient
   17  Compensation System in the performance of the functions and
   18  duties required of the system under this part.
   19         (2) The trust fund is established for the deposit of
   20  contributions required to be paid by providers pursuant to s.
   21  766.408. Notwithstanding s. 216.301 and pursuant to s. 216.351,
   22  any balance in the trust fund at the end of a fiscal year
   23  remains in the trust fund and is available for carrying out the
   24  purposes of the trust fund.
   25         (3) In accordance with s. 19(f)(2), Art. III of the State
   26  Constitution, unless terminated sooner, the trust fund is
   27  terminated on July 1, 2019. Before its scheduled termination,
   28  the trust fund shall be reviewed as provided in s. 215.3206(1)
   29  and (2).
   30         Section 2. This act shall take effect on the same date that
   31  SB ____ or similar legislation takes effect if such legislation
   32  is adopted in the same legislative session, or an extension
   33  thereof, and becomes law and only if this act is enacted by a
   34  three-fifths vote of the membership of each house of the
   35  Legislature.
