1 A bill to be entitled
2 An act relating to state minimum wage; amending s.
3 448.110, F.S.; prohibiting an employer or any other
4 party from knowingly procuring labor from any person
5 with an intent to defraud or deceive such person;
6 providing a penalty; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (5) of section 448.110, Florida
11 Statutes, is amended to read:
12 448.110 State minimum wage; annual wage adjustment;
13 enforcement.—
14 (5) It shall be unlawful for An employer or any other party
15 may not: to
16 (a) Discriminate in any manner or take adverse action
17 against any person in retaliation for exercising rights
18 protected pursuant to s. 24, Art. X of the State Constitution.
19 Rights protected include, but are not limited to, the right to
20 file a complaint or inform any person of his or her potential
21 rights pursuant to s. 24, Art. X of the State Constitution and
22 to assist him or her in asserting such rights.
23 (b) Knowingly procure labor from any person with an intent
24 to defraud or deceive such person.
25 (c) A violation of paragraph (b) of this subsection is a
26 felony of the third degree, punishable as provided in s.
27 775.082, s. 775.083, or s. 775.084.
28 Section 2. This act shall take effect July 1, 2015.
