       The Committee on Fiscal Policy (Stargel) recommended the
       following:
       
    1         Senate Amendment to Amendment (561494) 
    2  
    3         Delete lines 22 - 34
    4  and insert:
    5         3. An administrative proceeding pursuant to s. 120.569 or
    6  s. 120.57 which challenges a methodology that is specified in an
    7  agency rule or in a reimbursement plan incorporated by reference
    8  in such rule and that is used to calculate a reimbursement rate
    9  may not result in a correction or an adjustment of a
   10  reimbursement rate for a rate period that occurred more than 5
   11  years before the date the petition initiating the proceeding was
   12  filed.
