    1                        A bill to be entitled                      
    2         An act relating to persons with developmental
    3         disabilities; amending s. 393.065, F.S.; requiring the
    4         Agency for Persons with Disabilities to allow an
    5         applicant whose parent or guardian is a member of the
    6         United States Armed Forces, the Florida National
    7         Guard, or the United States Reserve Forces to receive
    8         Medicaid home and community-based waiver program
    9         services under certain conditions; providing an
   10         effective date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Present subsection (7) of section 393.065,
   15  Florida Statutes, is redesignated as subsection (8), and a new
   16  subsection (7) is added to that section, to read:
   17         393.065 Application and eligibility determination.—
   18         (7) The agency shall allow an applicant who meets the
   19  eligibility requirements of subsection (1) to receive home and
   20  community-based services in this state if:
   21         (a) The applicant’s parent or legal guardian is a military
   22  servicemember on active duty and, at the time of the
   23  servicemember’s transfer to this state, the applicant was
   24  receiving home and community-based services in another state; or
   25         (b) The applicant’s parent or legal guardian is a member of
   26  the Florida National Guard or a member of the United States
   27  Reserve Forces and is based in this state.
   28         Section 2. This act shall take effect July 1, 2015.
