       Senator Clemens moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete line 85
    4  and insert:
    5  incest, domestic violence, or human trafficking. A woman who
    6  states that she is a victim of rape, incest, domestic violence,
    7  or human trafficking and is not able to present to the physician
    8  a copy of a restraining order, police report, medical record, or
    9  other court order or documentation evidencing her statement has
   10  a right to waive the 24-hour mandatory waiting period. In the
   11  event a woman exercises her right to waive the state-mandated
   12  delay, the woman’s health care provider is not subject to any
   13  criminal, civil, or administrative penalties for failure to
   14  secure consent 24 hours in advance of the procedure. A signed
   15  acknowledgement from the woman stating that she has exercised
   16  her right to waive certain requirements is sufficient proof of
   17  provider compliance. This section does not alter the health care
   18  provider’s duty to obtain voluntary and informed consent as
   19  otherwise required by this section.
