Senator Benacquisto moved the following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Paragraph (k) is added to subsection (2) of
6 section 934.03, Florida Statutes, to read:
7 934.03 Interception and disclosure of wire, oral, or
8 electronic communications prohibited.—
9 (2)
10 (k) It is lawful under ss. 934.03-934.09 for a child under
11 18 years of age to intercept and record an oral communication if
12 the child is a party to the communication and has reasonable
13 grounds to believe that recording the communication will capture
14 a statement by another party to the communication that the other
15 party intends to commit, is committing, or has committed an
16 unlawful sexual act or an unlawful act of physical force or
17 violence against the child.
18 Section 2. This act shall take effect July 1, 2015.

20 And the title is amended as follows:
21 Delete everything before the enacting clause
22 and insert:
23 A bill to be entitled
24 An act relating to interception of wire, oral, or
25 electronic communication; amending s. 934.03, F.S.;
26 authorizing a child younger than 18 years of age to
27 intercept and record an oral communication if the
28 child is a party to the communication and certain
29 conditions are met; providing an effective date.
