       Senator Garcia moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 828 and 829
    4  insert:
    5         Section 15. Paragraph (m) is added to subsection (4) of
    6  section 322.142, Florida Statutes, to read:
    7         322.142 Color photographic or digital imaged licenses.—
    8         (4) The department may maintain a film negative or print
    9  file. The department shall maintain a record of the digital
   10  image and signature of the licensees, together with other data
   11  required by the department for identification and retrieval.
   12  Reproductions from the file or digital record are exempt from
   13  the provisions of s. 119.07(1) and may be made and issued only:
   14         (m) For fraud prevention purposes pursuant to an agreement
   15  with a department or agency of the state.
   16         Section 16. Paragraph (b) of subsection (1) of section
   17  322.143, Florida Statutes, is amended to read:
   18         322.143 Use of a driver license or identification card.—
   19         (1) As used in this section, the term:
   20         (b) “Private entity” means any nongovernmental entity, such
   21  as a corporation, partnership, company or nonprofit
   22  organization, any other legal entity, or any natural person.
   23  This term does not include a nongovernmental entity whose sole
   24  business is providing fraud prevention services pursuant to an
   25  agreement with a department or agency of the state.

   29         Delete line 73
   30  and insert:
   31         nature; amending s. 322.142 F.S.; authorizing the
   32         Department of Highway Safety and Motor Vehicles to
   33         make and issue reproductions from the files or digital
   34         records of certain licensees to be used for fraud
   35         prevention purposes under certain circumstances;
   36         amending s. 322.143, F.S.; redefining the term
   37         “private entity”; amending s. 324.242, F.S.; revising
   38         conditions
