       The Committee on Health Policy (Sobel) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 610 - 613
    4  and insert:
    5         2. A municipality must determine by ordinance the criteria
    6  for the number, location, and other permitting requirements for
    7  all retail facilities located within its municipal boundaries. A
    8  retail facility may be established in a municipality only after
    9  such an ordinance has been created. A county must determine by
   10  ordinance the criteria for the number, location, and other
   11  permitting requirements for all retail facilities located within
   12  the unincorporated areas of that county. A retail facility may
   13  be established in the unincorporated areas of a county only
   14  after such an ordinance has
