       Senator Hukill moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 82 - 127
    4  and insert:
    5  from the air with the use of a drone.
    6         (4) EXCEPTIONS.—This section act does not prohibit the use
    7  of a drone:
    8         (a) To counter a high risk of a terrorist attack by a
    9  specific individual or organization if the United States
   10  Secretary of Homeland Security determines that credible
   11  intelligence indicates that there is such a risk.
   12         (b) If the law enforcement agency first obtains a search
   13  warrant signed by a judge authorizing the use of a drone.
   14         (c) If the law enforcement agency possesses reasonable
   15  suspicion that, under particular circumstances, swift action is
   16  needed to prevent imminent danger to life or serious damage to
   17  property, to forestall the imminent escape of a suspect or the
   18  destruction of evidence, or to achieve purposes including, but
   19  not limited to, facilitating the search for a missing person.
   20         (d) By a person or an entity engaged in a business or
   21  profession licensed by the state, or by an agent, employee, or
   22  contractor thereof, if the drone is used only to perform
   23  reasonable tasks within the scope of practice or activities
   24  permitted under such person’s or entity’s license. However, this
   25  exception does not apply to a profession in which the licensee’s
   26  authorized scope of practice includes obtaining information
   27  about the identity, habits, conduct, movements, whereabouts,
   28  affiliations, associations, transactions, reputation, or
   29  character of any society, person, or group of persons.
   30         (e) By an employee or a contractor of a property appraiser
   31  who uses a drone solely for the purpose of assessing property
   32  for ad valorem taxation.
   33         (f) To capture images by or for an electric, water, or
   34  natural gas utility:
   35         1. For operations and maintenance of utility facilities,
   36  including facilities used in the generation, transmission, or
   37  distribution of electricity, gas, or water, for the purpose of
   38  maintaining utility system reliability and integrity;
   39         2. For inspecting utility facilities, including pipelines,
   40  to determine construction, repair, maintenance, or replacement
   41  needs before, during, and after construction of such facilities;
   42         3. For assessing vegetation growth for the purpose of
   43  maintaining clearances on utility rights-of­way;
   44         4. For utility routing, siting, and permitting for the
   45  purpose of constructing utility facilities or providing utility
   46  service; or
   47         5. For conducting environmental monitoring, as provided by
   48  federal, state, or local law, rule, or permit.
   49         (g) For aerial mapping, if the person or entity using a
   50  drone for this purpose is operating in compliance with Federal
   51  Aviation Administration regulations.
   52         (h) To deliver cargo, if the person or entity using a drone
   53  for this purpose is operating in compliance with Federal
   54  Aviation Administration regulations.
   55         (i) To capture images necessary for the safe operation or
   56  navigation of a drone that is being used for a purpose allowed
   57  under federal or Florida law.

   61         Delete line 18
   62  and insert:
   63         certain utilities for specified purposes; authorizing
   64         the use of a drone for aerial mapping under certain
   65         circumstances; authorizing the use of a drone for
   66         delivering cargo under certain circumstances;
   67         authorizing the use of a drone to capture certain
   68         images under certain circumstances; providing
