       The Committee on Environmental Preservation and Conservation
       (Dean) recommended the following:
       
    1         Senate Amendment to Amendment (612098) 
    2  
    3         Delete lines 3012 - 3026
    4  and insert:
    5         (b) Adopt by rule a specific surface water classification
    6  to protect surface waters used for treated potable water supply.
    7  These designated surface waters shall have the same water
    8  quality criteria protections as waters designated for fish
    9  consumption, recreation, and the propagation and maintenance of
   10  a healthy, well-balanced population of fish and wildlife, and
   11  shall be free from discharged substances at a concentration
   12  that, alone or in combination with other discharged substances,
   13  would require significant alteration of permitted treatment
   14  processes at the permitted treatment facility or that would
   15  otherwise prevent compliance with applicable state drinking
   16  water standards in the treated water. Notwithstanding this
   17  classification or the inclusion of treated water supply as a
   18  designated use of a surface water, a surface water used for
   19  treated potable water supply may be reclassified to the potable
   20  water supply classification.
