    1                        A bill to be entitled                      
    2         An act relating to freight mobility and trade
    3         projects; amending s. 319.32, F.S., relating to fees
    4         collected by the Department of Highway Safety and
    5         Motor Vehicles for issuance of motor vehicle
    6         certificates of title and related services; providing
    7         for certain funds in the State Transportation Trust
    8         Fund to be set aside for specified freight mobility
    9         and trade projects; amending s. 320.08, F.S., relating
   10         to motor vehicle license taxes; providing that certain
   11         fees collected shall be set aside for specified
   12         freight mobility and trade projects; providing an
   13         effective date.
   14          
   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. Subsection (5) of section 319.32, Florida
   18  Statutes, is amended to read:
   19         319.32 Fees; service charges; disposition.—
   20         (5)(a) Forty-seven dollars of each fee collected, except
   21  for fees charged on a certificate of title for a motor vehicle
   22  for hire registered under s. 320.08(6), for each applicable
   23  original certificate of title and each applicable duplicate copy
   24  of a certificate of title, after deducting the service charges
   25  imposed by s. 215.20, shall be deposited into the State
   26  Transportation Trust Fund. Any deposits in excess of $200
   27  million in any fiscal year shall be set aside for freight
   28  mobility and trade projects identified in the Freight Mobility
   29  and Trade Plan pursuant to s. 334.044 or for navigational
   30  channel deepening or maintenance projects approved by the United
   31  States Army Corps of Engineers. Deposits to the State
   32  Transportation Trust Fund pursuant to this paragraph may not
   33  exceed $200 million in any fiscal year, and any collections in
   34  excess of that amount during the fiscal year shall be paid into
   35  the General Revenue Fund.
   36         (b) All fees collected pursuant to subsection (3) shall be
   37  paid into the Nongame Wildlife Trust Fund. Twenty-one dollars of
   38  each fee, except for fees charged on a certificate of title for
   39  a motor vehicle for hire registered under s. 320.08(6), for each
   40  applicable original certificate of title and each applicable
   41  duplicate copy of a certificate of title, after deducting the
   42  service charges imposed by s. 215.20, shall be deposited into
   43  the State Transportation Trust Fund. All other fees collected by
   44  the department under this chapter shall be paid into the State
   45  Transportation Trust Fund and used to fund freight mobility and
   46  trade projects identified in the Freight Mobility and Trade Plan
   47  pursuant to s. 334.044 or for navigational channel deepening or
   48  maintenance projects approved by the United States Army Corps of
   49  Engineers General Revenue Fund.
   50         Section 2. Subsections (4), (5), (7), (8), and (15) of
   51  section 320.08, Florida Statutes, are amended to read:
   52         320.08 License taxes.—Except as otherwise provided herein,
   53  there are hereby levied and imposed annual license taxes for the
   54  operation of motor vehicles, mopeds, motorized bicycles as
   55  defined in s. 316.003(2), tri-vehicles as defined in s. 316.003,
   56  and mobile homes, as defined in s. 320.01, which shall be paid
   57  to and collected by the department or its agent upon the
   58  registration or renewal of registration of the following:
   59         (4) HEAVY TRUCKS, TRUCK TRACTORS, FEES ACCORDING TO GROSS
   60  VEHICLE WEIGHT.—
   61         (a) Gross vehicle weight of 5,001 pounds or more, but less
   62  than 6,000 pounds: $60.75 flat, of which $15.75 shall be set
   63  aside for freight mobility and trade projects identified in the
   64  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
   65  navigational channel deepening or maintenance projects approved
   66  by the United States Army Corps of Engineers deposited into the
   67  General Revenue Fund.
   68         (b) Gross vehicle weight of 6,000 pounds or more, but less
   69  than 8,000 pounds: $87.75 flat, of which $22.75 shall be set
   70  aside for freight mobility and trade projects identified in the
   71  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
   72  navigational channel deepening or maintenance projects approved
   73  by the United States Army Corps of Engineers deposited into the
   74  General Revenue Fund.
   75         (c) Gross vehicle weight of 8,000 pounds or more, but less
   76  than 10,000 pounds: $103 flat, of which $27 shall be set aside
   77  for freight mobility and trade projects identified in the
   78  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
   79  navigational channel deepening or maintenance projects approved
   80  by the United States Army Corps of Engineers deposited into the
   81  General Revenue Fund.
   82         (d) Gross vehicle weight of 10,000 pounds or more, but less
   83  than 15,000 pounds: $118 flat, of which $31 shall be set aside
   84  for freight mobility and trade projects identified in the
   85  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
   86  navigational channel deepening or maintenance projects approved
   87  by the United States Army Corps of Engineers deposited into the
   88  General Revenue Fund.
   89         (e) Gross vehicle weight of 15,000 pounds or more, but less
   90  than 20,000 pounds: $177 flat, of which $46 shall be set aside
   91  for freight mobility and trade projects identified in the
   92  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
   93  navigational channel deepening or maintenance projects approved
   94  by the United States Army Corps of Engineers deposited into the
   95  General Revenue Fund.
   96         (f) Gross vehicle weight of 20,000 pounds or more, but less
   97  than 26,001 pounds: $251 flat, of which $65 shall be set aside
   98  for freight mobility and trade projects identified in the
   99  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  100  navigational channel deepening or maintenance projects approved
  101  by the United States Army Corps of Engineers deposited into the
  102  General Revenue Fund.
  103         (g) Gross vehicle weight of 26,001 pounds or more, but less
  104  than 35,000: $324 flat, of which $84 shall be set aside for
  105  freight mobility and trade projects identified in the Freight
  106  Mobility and Trade Plan pursuant to s. 334.044 or for
  107  navigational channel deepening or maintenance projects approved
  108  by the United States Army Corps of Engineers deposited into the
  109  General Revenue Fund.
  110         (h) Gross vehicle weight of 35,000 pounds or more, but less
  111  than 44,000 pounds: $405 flat, of which $105 shall be set aside
  112  for freight mobility and trade projects identified in the
  113  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  114  navigational channel deepening or maintenance projects approved
  115  by the United States Army Corps of Engineers deposited into the
  116  General Revenue Fund.
  117         (i) Gross vehicle weight of 44,000 pounds or more, but less
  118  than 55,000 pounds: $773 flat, of which $201 shall be set aside
  119  for freight mobility and trade projects identified in the
  120  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  121  navigational channel deepening or maintenance projects approved
  122  by the United States Army Corps of Engineers deposited into the
  123  General Revenue Fund.
  124         (j) Gross vehicle weight of 55,000 pounds or more, but less
  125  than 62,000 pounds: $916 flat, of which $238 shall be set aside
  126  for freight mobility and trade projects identified in the
  127  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  128  navigational channel deepening or maintenance projects approved
  129  by the United States Army Corps of Engineers deposited into the
  130  General Revenue Fund.
  131         (k) Gross vehicle weight of 62,000 pounds or more, but less
  132  than 72,000 pounds: $1,080 flat, of which $280 shall be set
  133  aside for freight mobility and trade projects identified in the
  134  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  135  navigational channel deepening or maintenance projects approved
  136  by the United States Army Corps of Engineers deposited into the
  137  General Revenue Fund.
  138         (l) Gross vehicle weight of 72,000 pounds or more: $1,322
  139  flat, of which $343 shall be set aside for freight mobility and
  140  trade projects identified in the Freight Mobility and Trade Plan
  141  pursuant to s. 334.044 or for navigational channel deepening or
  142  maintenance projects approved by the United States Army Corps of
  143  Engineers deposited into the General Revenue Fund.
  144         (m) Notwithstanding the declared gross vehicle weight, a
  145  truck tractor used within a 150-mile radius of its home address
  146  is eligible for a license plate for a fee of $324 flat if:
  147         1. The truck tractor is used exclusively for hauling
  148  forestry products; or
  149         2. The truck tractor is used primarily for the hauling of
  150  forestry products, and is also used for the hauling of
  151  associated forestry harvesting equipment used by the owner of
  152  the truck tractor.

  154  Of the fee imposed by this paragraph, $84 shall be set aside for
  155  freight mobility and trade projects identified in the Freight
  156  Mobility and Trade Plan pursuant to s. 334.044 or for
  157  navigational channel deepening or maintenance projects approved
  158  by the United States Army Corps of Engineers deposited into the
  159  General Revenue Fund.
  160         (n) A truck tractor or heavy truck, not operated as a for
  161  hire vehicle, which is engaged exclusively in transporting raw,
  162  unprocessed, and nonmanufactured agricultural or horticultural
  163  products within a 150-mile radius of its home address, is
  164  eligible for a restricted license plate for a fee of:
  165         1. If such vehicle’s declared gross vehicle weight is less
  166  than 44,000 pounds, $87.75 flat, of which $22.75 shall be set
  167  aside for freight mobility and trade projects identified in the
  168  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  169  navigational channel deepening or maintenance projects approved
  170  by the United States Army Corps of Engineers deposited into the
  171  General Revenue Fund.
  172         2. If such vehicle’s declared gross vehicle weight is
  173  44,000 pounds or more and such vehicle only transports from the
  174  point of production to the point of primary manufacture; to the
  175  point of assembling the same; or to a shipping point of a rail,
  176  water, or motor transportation company, $324 flat, of which $84
  177  shall be set aside for freight mobility and trade projects
  178  identified in the Freight Mobility and Trade Plan pursuant to s.
  179  334.044 or for navigational channel deepening or maintenance
  180  projects approved by the United States Army Corps of Engineers
  181  deposited into the General Revenue Fund.
  182  
  183  Such not-for-hire truck tractors and heavy trucks used
  184  exclusively in transporting raw, unprocessed, and
  185  nonmanufactured agricultural or horticultural products may be
  186  incidentally used to haul farm implements and fertilizers
  187  delivered direct to the growers. The department may require any
  188  documentation deemed necessary to determine eligibility prior to
  189  issuance of this license plate. For the purpose of this
  190  paragraph, “not-for-hire” means the owner of the motor vehicle
  191  must also be the owner of the raw, unprocessed, and
  192  nonmanufactured agricultural or horticultural product, or the
  193  user of the farm implements and fertilizer being delivered.
  194         (5) SEMITRAILERS, FEES ACCORDING TO GROSS VEHICLE WEIGHT;
  195  SCHOOL BUSES; SPECIAL PURPOSE VEHICLES.—
  196         (a)1. A semitrailer drawn by a GVW truck tractor by means
  197  of a fifth-wheel arrangement: $13.50 flat per registration year
  198  or any part thereof, of which $3.50 shall be set aside for
  199  freight mobility and trade projects identified in the Freight
  200  Mobility and Trade Plan pursuant to s. 334.044 or for
  201  navigational channel deepening or maintenance projects approved
  202  by the United States Army Corps of Engineers deposited into the
  203  General Revenue Fund.
  204         2. A semitrailer drawn by a GVW truck tractor by means of a
  205  fifth-wheel arrangement: $68 flat per permanent registration, of
  206  which $18 shall be set aside for freight mobility and trade
  207  projects identified in the Freight Mobility and Trade Plan
  208  pursuant to s. 334.044 or for navigational channel deepening or
  209  maintenance projects approved by the United States Army Corps of
  210  Engineers deposited into the General Revenue Fund.
  211         (b) A motor vehicle equipped with machinery and designed
  212  for the exclusive purpose of well drilling, excavation,
  213  construction, spraying, or similar activity, and which is not
  214  designed or used to transport loads other than the machinery
  215  described above over public roads: $44 flat, of which $11.50
  216  shall be set aside for freight mobility and trade projects
  217  identified in the Freight Mobility and Trade Plan pursuant to s.
  218  334.044 or for navigational channel deepening or maintenance
  219  projects approved by the United States Army Corps of Engineers
  220  deposited into the General Revenue Fund.
  221         (c) A school bus used exclusively to transport pupils to
  222  and from school or school or church activities or functions
  223  within their own county: $41 flat, of which $11 shall be set
  224  aside for freight mobility and trade projects identified in the
  225  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  226  navigational channel deepening or maintenance projects approved
  227  by the United States Army Corps of Engineers deposited into the
  228  General Revenue Fund.
  229         (d) A wrecker, as defined in s. 320.01, which is used to
  230  tow a vessel as defined in s. 327.02, a disabled, abandoned,
  231  stolen-recovered, or impounded motor vehicle as defined in s.
  232  320.01, or a replacement motor vehicle as defined in s. 320.01:
  233  $41 flat, of which $11 shall be set aside for freight mobility
  234  and trade projects identified in the Freight Mobility and Trade
  235  Plan pursuant to s. 334.044 or for navigational channel
  236  deepening or maintenance projects approved by the United States
  237  Army Corps of Engineers deposited into the General Revenue Fund.
  238         (e) A wrecker that is used to tow any nondisabled motor
  239  vehicle, a vessel, or any other cargo unless used as defined in
  240  paragraph (d), as follows:
  241         1. Gross vehicle weight of 10,000 pounds or more, but less
  242  than 15,000 pounds: $118 flat, of which $31 shall be set aside
  243  for freight mobility and trade projects identified in the
  244  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  245  navigational channel deepening or maintenance projects approved
  246  by the United States Army Corps of Engineers deposited into the
  247  General Revenue Fund.
  248         2. Gross vehicle weight of 15,000 pounds or more, but less
  249  than 20,000 pounds: $177 flat, of which $46 shall be set aside
  250  for freight mobility and trade projects identified in the
  251  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  252  navigational channel deepening or maintenance projects approved
  253  by the United States Army Corps of Engineers deposited into the
  254  General Revenue Fund.
  255         3. Gross vehicle weight of 20,000 pounds or more, but less
  256  than 26,000 pounds: $251 flat, of which $65 shall be set aside
  257  for freight mobility and trade projects identified in the
  258  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  259  navigational channel deepening or maintenance projects approved
  260  by the United States Army Corps of Engineers deposited into the
  261  General Revenue Fund.
  262         4. Gross vehicle weight of 26,000 pounds or more, but less
  263  than 35,000 pounds: $324 flat, of which $84 shall be set aside
  264  for freight mobility and trade projects identified in the
  265  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  266  navigational channel deepening or maintenance projects approved
  267  by the United States Army Corps of Engineers deposited into the
  268  General Revenue Fund.
  269         5. Gross vehicle weight of 35,000 pounds or more, but less
  270  than 44,000 pounds: $405 flat, of which $105 shall be set aside
  271  for freight mobility and trade projects identified in the
  272  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  273  navigational channel deepening or maintenance projects approved
  274  by the United States Army Corps of Engineers deposited into the
  275  General Revenue Fund.
  276         6. Gross vehicle weight of 44,000 pounds or more, but less
  277  than 55,000 pounds: $772 flat, of which $200 shall be set aside
  278  for freight mobility and trade projects identified in the
  279  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  280  navigational channel deepening or maintenance projects approved
  281  by the United States Army Corps of Engineers deposited into the
  282  General Revenue Fund.
  283         7. Gross vehicle weight of 55,000 pounds or more, but less
  284  than 62,000 pounds: $915 flat, of which $237 shall be set aside
  285  for freight mobility and trade projects identified in the
  286  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  287  navigational channel deepening or maintenance projects approved
  288  by the United States Army Corps of Engineers deposited into the
  289  General Revenue Fund.
  290         8. Gross vehicle weight of 62,000 pounds or more, but less
  291  than 72,000 pounds: $1,080 flat, of which $280 shall be set
  292  aside for freight mobility and trade projects identified in the
  293  Freight Mobility and Trade Plan pursuant to s. 334.044 or for
  294  navigational channel deepening or maintenance projects approved
  295  by the United States Army Corps of Engineers deposited into the
  296  General Revenue Fund.
  297         9. Gross vehicle weight of 72,000 pounds or more: $1,322
  298  flat, of which $343 shall be set aside for freight mobility and
  299  trade projects identified in the Freight Mobility and Trade Plan
  300  pursuant to s. 334.044 or for navigational channel deepening or
  301  maintenance projects approved by the United States Army Corps of
  302  Engineers deposited into the General Revenue Fund.
  303         (f) A hearse or ambulance: $40.50 flat, of which $10.50
  304  shall be set aside for freight mobility and trade projects
  305  identified in the Freight Mobility and Trade Plan pursuant to s.
  306  334.044 or for navigational channel deepening or maintenance
  307  projects approved by the United States Army Corps of Engineers
  308  deposited into the General Revenue Fund.
  309         (7) TRAILERS FOR PRIVATE USE.—
  310         (a) Any trailer weighing 500 pounds or less: $6.75 flat per
  311  year or any part thereof, of which $1.75 shall be set aside for
  312  freight mobility and trade projects identified in the Freight
  313  Mobility and Trade Plan pursuant to s. 334.044 or for
  314  navigational channel deepening or maintenance projects approved
  315  by the United States Army Corps of Engineers deposited into the
  316  General Revenue Fund.
  317         (b) Net weight over 500 pounds: $3.50 flat, of which $1
  318  shall be deposited into the General Revenue Fund; plus $1 per
  319  cwt, of which 25 cents shall be set aside for freight mobility
  320  and trade projects identified in the Freight Mobility and Trade
  321  Plan pursuant to s. 334.044 or for navigational channel
  322  deepening or maintenance projects approved by the United States
  323  Army Corps of Engineers deposited into the General Revenue Fund.
  324         (8) TRAILERS FOR HIRE.—
  325         (a) Net weight under 2,000 pounds: $3.50 flat, of which $1
  326  shall be deposited into the General Revenue Fund; plus $1.50 per
  327  cwt, of which 50 cents shall be set aside for freight mobility
  328  and trade projects identified in the Freight Mobility and Trade
  329  Plan pursuant to s. 334.044 or for navigational channel
  330  deepening or maintenance projects approved by the United States
  331  Army Corps of Engineers deposited into the General Revenue Fund.
  332         (b) Net weight 2,000 pounds or more: $13.50 flat, of which
  333  $3.50 shall be deposited into the General Revenue Fund; plus
  334  $1.50 per cwt, of which 50 cents shall be set aside for freight
  335  mobility and trade projects identified in the Freight Mobility
  336  and Trade Plan pursuant to s. 334.044 or for navigational
  337  channel deepening or maintenance projects approved by the United
  338  States Army Corps of Engineers deposited into the General
  339  Revenue Fund.
  340         (15) TRANSPORTER.—Any transporter license plate issued to a
  341  transporter pursuant to s. 320.133: $101.25 flat, of which
  342  $26.25 shall be set aside for freight mobility and trade
  343  projects identified in the Freight Mobility and Trade Plan
  344  pursuant to s. 334.044 or for navigational channel deepening or
  345  maintenance projects approved by the United States Army Corps of
  346  Engineers deposited into the General Revenue Fund.
  347         Section 3. This act shall take effect July 1, 2015.
