    1                        A bill to be entitled                      
    2         An act relating to anatomical gifts; amending s.
    3         765.521, F.S.; requiring the Department of Highway
    4         Safety and Motor Vehicles to designate points of
    5         contact at offices and facilities of the department;
    6         requiring points of contact to ask persons transacting
    7         business with the department if they would like to
    8         become an organ donor; requiring the department to
    9         maintain an integrated website link to the organ
   10         donation registry; requiring the department to
   11         establish a procedure requiring department staff to
   12         confirm electronically that the organ donor question
   13         has been asked; providing for the future applicability
   14         of an amendment upon the development and
   15         implementation of a project by the department;
   16         providing an effective date.

   18  Be It Enacted by the Legislature of the State of Florida:
   19  
   20         Section 1. Subsection (1) of section 765.521, Florida
   21  Statutes, is amended, present subsections (2) and (3) of that
   22  section are redesignated as subsections (3) and (4),
   23  respectively, and a new subsection (2) is added to that section,
   24  to read:
   25         765.521 Donations as part of driver license or
   26  identification card process.—
   27         (1) The agency and the department shall develop and
   28  implement a program encouraging and allowing persons to make
   29  anatomical gifts as a part of the process of issuing
   30  identification cards and issuing and renewing driver licenses.
   31  The department shall designate individuals employed in each
   32  department office or facility as points of contact and require
   33  them to ask each person transacting business with the department
   34  if he or she would like to become an organ donor. The donor
   35  registration card distributed by the department shall include
   36  the information required by the uniform donor card under s.
   37  765.514 and such additional information as determined necessary
   38  by the department. The department shall also develop and
   39  implement a program to identify donors which includes notations
   40  on identification cards, driver licenses, and driver records or
   41  such other methods as the department develops to clearly
   42  indicate the individual’s intent to make an anatomical gift. A
   43  notation on an individual’s driver license or identification
   44  card that the individual intends to make an anatomical gift
   45  satisfies all requirements for consent to organ or tissue
   46  donation. The agency shall provide the necessary supplies and
   47  forms from funds appropriated from general revenue or
   48  contributions from interested voluntary, nonprofit
   49  organizations. The department shall provide the necessary
   50  recordkeeping system from funds appropriated from general
   51  revenue. The department and the agency shall incur no liability
   52  in connection with the performance of any acts authorized
   53  herein.
   54         (2) The department shall maintain an integrated link on its
   55  website referring a visitor renewing a driver license or
   56  conducting other business on the website to the organ donation
   57  registry under s. 765.5155. The department shall establish a
   58  procedure requiring department staff to confirm electronically
   59  that the organ donor question required by subsection (1) has
   60  been asked of each person entering the office or facility to
   61  conduct business.
   62         Section 2. The amendment made by this act in s. 765.521(2),
   63  Florida Statutes, shall apply upon the development and
   64  implementation of the vehicle registration system modernization
   65  project by the Department of Highway Safety and Motor Vehicles.
   66         Section 3. This act shall take effect July 1, 2015.
