1 A bill to be entitled
2 An act relating to intimate apparel; creating s.
3 501.935, F.S.; prohibiting retail stores from allowing
4 a customer to try on intimate apparel in the store
5 unless it is tried on over clothing or with a
6 disposable shield; prohibiting a retail store from
7 selling intimate apparel that has been tried on in
8 violation of the prohibition; defining the term
9 “intimate apparel”; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 501.935, Florida Statutes, is created to
14 read:
15 501.935 Intimate apparel.—A retail store may not allow a
16 customer to try on intimate apparel in the store unless the item
17 is tried on over clothing or a disposable shield is used. If a
18 customer tries on an item of intimate apparel in violation of
19 this section, the item is considered defective, and the retail
20 store may not sell the item. As used in this section, the term
21 “intimate apparel” includes lower undergarments and swimsuit
22 bottoms.
23 Section 2. This act shall take effect July 1, 2016.
