       Senators Diaz de la Portilla and Abruzzo moved the following:
       
    1         Senate Amendment to Amendment (926844) (with title
    2  amendment)

    4         Between lines 1075 and 1076
    5  insert:
    6         Section 40. Paragraph (b) of subsection (5) of section
    7  849.086, Florida Statutes, is amended to read:
    8         849.086 Cardrooms authorized.—
    9         (5) LICENSE REQUIRED; APPLICATION; FEES.—No person may
   10  operate a cardroom in this state unless such person holds a
   11  valid cardroom license issued pursuant to this section.
   12         (b) After the initial cardroom license is granted, the
   13  application for the annual license renewal shall be made in
   14  conjunction with the applicant’s annual application for its
   15  pari-mutuel license. If a permitholder has operated a cardroom
   16  during any of the 3 previous fiscal years and fails to include a
   17  renewal request for the operation of the cardroom in its annual
   18  application for license renewal, the permitholder may amend its
   19  annual application to include operation of the cardroom. In
   20  order for a cardroom license to be renewed, the applicant,
   21  except for a greyhound racing permitholder, must have requested,
   22  as part of its pari-mutuel annual license application, to
   23  conduct at least 90 percent of the total number of live
   24  performances conducted by such permitholder during either the
   25  state fiscal year in which its initial cardroom license was
   26  issued or the state fiscal year immediately prior thereto if the
   27  permitholder ran at least a full schedule of live racing or
   28  games in the prior year. If the application is for a harness
   29  permitholder cardroom, the applicant must have requested
   30  authorization to conduct a minimum of 140 live performances
   31  during the state fiscal year immediately prior thereto. If more
   32  than one permitholder is operating at a facility, each
   33  permitholder must have applied for a license to conduct a full
   34  schedule of live racing.

   38         Delete line 1220
   39  and insert:
   40         adopt rules; amending s. 849.086, F.S.; exempting a
   41         greyhound racing permitholder from a specified
   42         cardroom license renewal requirement; providing an
   43         effective date.
