       Senator Hays moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 1276 and 1277
    4  insert:
    5         Section 10. Subsection (3) of section 1003.455, Florida
    6  Statutes, is amended, and subsection (6) is added to that
    7  section, to read:
    8         1003.455 Physical education; assessment.—
    9         (3) Each district school board shall provide 150 minutes of
   10  physical education each week for students in kindergarten
   11  through grade 5 and for students in grade 6 who are enrolled in
   12  a school that contains one or more elementary grades so that on
   13  any day during which physical education instruction is conducted
   14  there are at least 30 consecutive minutes of physical education
   15  instruction per day. Beginning with the 2009-2010 school year,
   16  the equivalent of one class period per day of physical education
   17  for one semester of each year is required for students enrolled
   18  in grades 6 through 8. Students enrolled in such instruction
   19  shall be reported through the periodic student membership
   20  surveys, and records of such enrollment shall be audited
   21  pursuant to s. 1010.305. Such instruction may be provided by any
   22  instructional personnel as defined in s. 1012.01(2), regardless
   23  of certification, who are designated by the school principal.
   24         (6) In addition to the requirements in subsection (3), each
   25  classroom teacher is required to allow their students at least
   26  100 minutes of supervised, safe, and unstructured free-play
   27  recess each week for students in kindergarten through grade 5
   28  and for students in grade 6 who are enrolled in a school that
   29  contains one or more elementary grades so that there are at
   30  least 15 consecutive minutes of free-play recess in the morning
   31  and 15 consecutive minutes of free-play recess in the afternoon
   32  per day.
