       Senator Braynon moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1130 and 1131
    4  insert:
    5         Section 40. Paragraph (b) of subsection (5) of section
    6  849.086, Florida Statutes, is amended to read:
    7         849.086 Cardrooms authorized.—
    8         (5) LICENSE REQUIRED; APPLICATION; FEES.—No person may
    9  operate a cardroom in this state unless such person holds a
   10  valid cardroom license issued pursuant to this section.
   11         (b) After the initial cardroom license is granted, the
   12  application for the annual license renewal shall be made in
   13  conjunction with the applicant’s annual application for its
   14  pari-mutuel license. If a permitholder has operated a cardroom
   15  during any of the 3 previous fiscal years and fails to include a
   16  renewal request for the operation of the cardroom in its annual
   17  application for license renewal, the permitholder may amend its
   18  annual application to include operation of the cardroom. In
   19  order for a cardroom license to be renewed the applicant must
   20  conduct at least a full schedule of live racing as defined in s.
   21  550.002 during each fiscal have requested, as part of its pari
   22  mutuel annual license application, to conduct at least 90
   23  percent of the total number of live performances conducted by
   24  such permitholder during either the state fiscal year in which
   25  its initial cardroom license was issued or the state fiscal year
   26  immediately prior thereto if the permitholder ran at least a
   27  full schedule of live racing or games in the prior year. If the
   28  application is for a harness permitholder cardroom, the
   29  applicant must have requested authorization to conduct a minimum
   30  of 140 live performances during the state fiscal year
   31  immediately prior thereto. If more than one permitholder is
   32  operating at a facility, each permitholder must have applied for
   33  a license to conduct a full schedule of live racing.

   37         Delete line 139
   38  and insert:
   39         adopt rules; amending s. 849.086, F.S.; revising
   40         requirements for renewal of a cardroom license;
   41         providing an effective date.
