    1                        A bill to be entitled                      
    2         An act relating to motor vehicle crash reports;
    3         amending s. 316.066, F.S.; authorizing a law
    4         enforcement officer to testify at a civil trial as to
    5         statements made to the officer by a person involved in
    6         a crash under certain circumstances; providing an
    7         effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (4) of section 316.066, Florida
   12  Statutes, is amended to read:
   13         316.066 Written reports of crashes.—
   14         (4) Except as specified in this subsection, each crash
   15  report made by a person involved in a crash and any statement
   16  made by such person to a law enforcement officer for the purpose
   17  of completing a crash report required by this section shall be
   18  without prejudice to the individual so reporting. Such report or
   19  statement may not be used as evidence in any trial, civil or
   20  criminal. However, subject to the applicable rules of evidence,
   21  a law enforcement officer at a criminal trial may testify as to
   22  any statement made to the officer by the person involved in the
   23  crash if that person’s privilege against self-incrimination is
   24  not violated. A law enforcement officer at a civil trial may
   25  testify as to any statement made to the officer by the person
   26  involved in the crash if such testimony impeaches the testimony
   27  of that person as to fault for the crash and if that person’s
   28  privilege against self-incrimination is not violated. The
   29  results of breath, urine, and blood tests administered as
   30  provided in s. 316.1932 or s. 316.1933 are not confidential and
   31  are admissible into evidence in accordance with the provisions
   32  of s. 316.1934(2).
   33         Section 2. This act shall take effect upon becoming a law.
