1 A bill to be entitled
2 An act relating to fines and forfeitures; amending s.
3 316.660, F.S.; requiring a county or municipality that
4 receives more than a specified percentage of its total
5 annual revenue for the prior fiscal year from fines
6 and forfeitures collected from traffic citations to
7 remit such excess revenue to the Department of Revenue
8 for deposit into the Crimes Compensation Trust Fund;
9 amending s. 932.7055, F.S.; prohibiting certain
10 proceeds deposited into a designated special law
11 enforcement trust fund by a county or municipal agency
12 from exceeding a specified percentage of the total
13 annual revenue for the prior fiscal year of the county
14 or municipality that oversees the agency; requiring
15 the agency to remit excess proceeds to the Department
16 of Revenue for deposit into the Crimes Compensation
17 Trust Fund; providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:

21 Section 1. Subsection (3) is added to section 316.660,
22 Florida Statutes, to read:
23 316.660 Disposition of fines and forfeitures collected for
24 violations; reporting requirement.—
25 (3) A county or municipality that receives more than 5
26 percent of its total annual revenue for the prior fiscal year
27 from fines and forfeitures collected from traffic citations
28 shall remit any revenue in excess of that amount to the
29 Department of Revenue for deposit into the Crimes Compensation
30 Trust Fund.
31 Section 2. Paragraph (a) of subsection (5) of section
32 932.7055, Florida Statutes, is amended to read:
33 932.7055 Disposition of liens and forfeited property.—
34 (5)(a)1. If the seizing agency is a county or municipal
35 agency, the remaining proceeds shall be deposited into in a
36 special law enforcement trust fund established by the board of
37 county commissioners or the governing body of the municipality.
38 Such proceeds and interest earned therefrom shall be used for
39 school resource officer, crime prevention, safe neighborhood,
40 drug abuse education and prevention programs, or for other law
41 enforcement purposes, which include defraying the cost of
42 protracted or complex investigations, providing additional
43 equipment or expertise, purchasing automated external
44 defibrillators for use in law enforcement vehicles, and
45 providing matching funds to obtain federal grants. The proceeds
46 and interest may not be used to meet normal operating expenses
47 of the law enforcement agency.
48 2. The amount of the remaining proceeds deposited into the
49 designated special law enforcement trust fund by each county or
50 municipal agency may not exceed 5 percent of the total annual
51 revenue for the prior fiscal year of the county or municipality
52 that oversees the agency. The agency shall remit any excess
53 proceeds to the Department of Revenue for deposit into the
54 Crimes Compensation Trust Fund.
55 Section 3. This act shall take effect July 1, 2016.
