    1                        A bill to be entitled                      
    2         An act relating to procurement procedures for
    3         educational institutions; amending s. 1010.04, F.S.;
    4         requiring each district school board and Florida
    5         College System institution board of trustees to review
    6         certain agreements and contracts before purchasing
    7         nonacademic commodities and contractual services under
    8         certain circumstances to determine whether the use of
    9         the agreements and contracts is economically
   10         advantageous; requiring that bid specifications
   11         include a specified statement; authorizing each
   12         district school board to also use specified
   13         cooperative state purchasing programs; providing an
   14         exception for certain services; authorizing specified
   15         educational institutions to make purchases through an
   16         online procurement system, an electronic auction
   17         service, or other efficient procurement tool;
   18         providing an effective date.

   20  Be It Enacted by the Legislature of the State of Florida:
   21  
   22         Section 1. Subsections (1) and (2) of section 1010.04,
   23  Florida Statutes, are amended to read:
   24         1010.04 Purchasing.—
   25         (1)(a) Purchases and leases by school districts and Florida
   26  College System institutions shall comply with the requirements
   27  of law and rules of the State Board of Education.
   28         (b) Before purchasing nonacademic commodities and
   29  contractual services, each district school board and Florida
   30  College System institution board of trustees shall review the
   31  purchasing agreements and state term contracts available under
   32  s. 287.056 to determine whether it is in the school board’s or
   33  the board of trustees’ economic advantage to use the agreements
   34  and contracts. Each bid specification for nonacademic
   35  commodities and contractual services must include a statement
   36  indicating that the purchasing agreements and state term
   37  contracts available under s. 287.056 have been reviewed. Each
   38  district school board may also use the cooperative state
   39  purchasing programs managed through the regional consortium
   40  service organizations pursuant to their authority under s.
   41  1001.451(3). This paragraph does not apply to services that are
   42  eligible for reimbursement under the federal E-rate program
   43  administered by the Universal Service Administrative Company.
   44         (c)(b) Purchases and leases by state universities shall
   45  comply with the requirements of law and regulations of the Board
   46  of Governors.
   47         (2) Each district school board and Florida College System
   48  institution board of trustees shall adopt rules, and each
   49  university board of trustees shall adopt regulations, to be
   50  followed in making purchases. Purchases may be made through an
   51  online procurement system, an electronic auction service, or
   52  other efficient procurement tool.
   53         Section 2. This act shall take effect July 1, 2016.
