       Senator Evers moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 366 - 375
    4  and insert:
    5         (c)1.Upon the registration of 250,000 active qualified
    6  patients in the compassionate use registry, authorize the
    7  establishment of three dispensing organizations. An applicant
    8  for approval as a dispensing organization under this paragraph
    9  must meet the requirements of subparagraphs (b)2.-7., be
   10  operated by a farmer, and demonstrate the technical and
   11  technological ability to cultivate and produce low-THC cannabis.
   12  The department must approve as a dispensing organization at
   13  least one applicant that is owned or operated by an individual
   14  that is both a recognized class member of Pigford v. Glickman,
   15  185 F.R.D. 82 (D.D.C. 1999), or In Re Black Farmers Litig., 856
   16  F. Supp. 2d 1 (D.D.C. 2011), and a member of the Black Farmers
   17  and Agriculturalists Association.
   18         2. For purposes of this paragraph, the term “farmer” means
   19  an individual owner or operator of a tract or tracts of land who
   20  is considered engaged in accepted agricultural practices.
