The Committee on Judiciary (Diaz de la Portilla) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Section 768.38, Florida Statutes, is created to
6 read:
7 768.38 Liability arising out of drone use.—Notwithstanding
8 s. 768.81, if a person suffers an injury or property damage
9 caused by the negligent operation of a drone, the owner and
10 operator of the drone are liable for damages on the basis of the
11 doctrine of joint and several liability. As used in this
12 section, the term “drone” has the same meaning as in s. 934.50.
13 Section 2. This act shall take effect July 1, 2016.

18 and insert:
19 A bill to be entitled
20 An act relating to drones; creating s. 768.38, F.S.;
21 providing for liability for damage to person or
22 property in this state for the operation of a drone;
23 defining a term; providing an effective date.
