       Senator Richter moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Delete lines 2251 - 2377
    4  and insert:
    5         Section 43. Subsection (1) and paragraph (d) of subsection
    6  (3) of section 559.9285, Florida Statutes, are amended to read:
    7         559.9285 Certification of business activities.—
    8         (1) Each certifying party, as defined in s. 559.927(2):
    9         (a) Which does not offer for sale, at wholesale or retail,
   10  prearranged travel or, tourist-related services, or tour-guide
   11  services for individuals or groups directly to any terrorist
   12  state and which originate in Florida;
   13         (b) Which offers for sale, at wholesale or retail, only
   14  prearranged travel or, tourist-related services, or tour-guide
   15  services for individuals or groups directly to any terrorist
   16  state and which originate in Florida, but engages in no other
   17  business dealings or commerce with any terrorist state; or
   18         (c) Which offers for sale, at wholesale or retail,
   19  prearranged travel or, tourist-related services, or tour-guide
   20  services for individuals or groups directly to any terrorist
   21  state and which originate in Florida, and also engages in any
   22  other business dealings or commerce with any terrorist state,
   23  
   24  shall annually certify its business activities by filing a
   25  disclosure statement with the department which accurately
   26  represents the scope of the seller’s business activities
   27  according to the criteria provided in paragraph (a), paragraph
   28  (b), or paragraph (c).
   29         (3) The department shall specify by rule the form of each
   30  certification under this section which shall include the
   31  following information:
   32         (d) The type of all prearranged travel or, tourist-related
   33  services, or tour-guide services that the certifying party
   34  offers for sale to individuals or groups traveling directly to
   35  any terrorist state and that originate in Florida, and the
   36  frequency with which such services are offered.
   37         Section 44. Subsection (2) of section 559.937, Florida
   38  Statutes, is amended to read:
   39         559.937 Criminal penalties.—Any person or business that
   40  violates this part:
   41         (2) Which violation directly or indirectly pertains to an
   42  offer to sell, at wholesale or retail, prearranged travel or,
   43  tourist-related services, or tour-guide services for individuals
   44  or groups directly to any terrorist state and which originate in
   45  Florida, commits a felony of the third degree, punishable as
   46  provided in s. 775.082 or s. 775.083.
   47         Section 45. For the 2016-2017 fiscal year, the sum of
   48  $1,305,097 in nonrecurring funds from the Division of Licensing
   49  Trust Fund is appropriated to the Department of Agriculture and
   50  Consumer Services for the purpose of implementing s. 493.6108,
   51  Florida Statutes, regarding the collection and subsequent
   52  payment of fingerprint retention and processing fees to the
   53  Florida Department of Law Enforcement.
   54         Section 46. Except as otherwise expressly provided in this
   55  act and except for this section, which shall take effect upon
   56  becoming law, this act shall take effect July 1, 2016.
