    1                        A bill to be entitled                      
    2         An act relating to permits for mangrove alteration and
    3         trimming; amending s. 403.9328, F.S.; authorizing the
    4         Department of Environmental Protection to issue
    5         permits for mangrove alteration and trimming to the
    6         owner of certain residential property; providing
    7         conditions for issuance of such permits; providing an
    8         effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (6) is added to section 403.9328,
   13  Florida Statutes, to read:
   14         403.9328 Alteration and trimming of mangroves; permit
   15  requirement.—
   16         (6) Notwithstanding any other provision of law, the
   17  department may issue a permit for mangrove alteration or
   18  trimming to the owner of a residential property of 5 acres or
   19  less if:
   20         (a) The mangroves to be altered or trimmed were originally
   21  planted voluntarily by the owner;
   22         (b) The alteration or trimming does not reduce the mangrove
   23  coverage by more than 70 percent along the shoreline; and
   24         (c) The owner demonstrates that new mangrove habitats are
   25  being created along the shoreline.
   26         Section 2. This act shall take effect July 1, 2017.
