    1                        A bill to be entitled                      
    2         An act relating to preinsurance inspection; amending
    3         s. 627.744, F.S.; providing an exception to the
    4         requirement that an insurer inspect private passenger
    5         motor vehicles before issuing certain motor vehicle
    6         insurance policies; requiring insurers using the
    7         exception to file a manual rule with the Office of
    8         Insurance Regulation; authorizing insurers to
    9         establish their own preinsurance inspection
   10         requirements; providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Paragraph (m) is added to subsection (2) of
   15  section 627.744, Florida Statutes, to read:
   16         627.744 Required preinsurance inspection of private
   17  passenger motor vehicles.—
   18         (2) This section does not apply:
   19         (m) If an insurer elects to opt out of inspection
   20  requirements under this section. An insurer opting out of the
   21  inspection must file a manual rule with the office indicating
   22  that the insurer will not participate in the inspection program
   23  under this section and will not require the preinsurance
   24  inspection of its insureds’ motor vehicles. An insurer that
   25  files such a manual rule with the office may establish its own
   26  preinsurance inspection requirements as a condition to issuing a
   27  private passenger motor vehicle insurance policy.
   28         Section 2. This act shall take effect July 1, 2017.
