    2         An act relating to home health services; amending s.
    3         400.462, F.S.; revising the definitions of the terms
    4         “home health agency” and “organization” to include
    5         certain marketing organizations for providers of home
    6         health, homemaker, and companion services; providing
    7         an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsections (12) and (22) of section 400.462,
   12  Florida Statutes, are amended to read:
   13         400.462 Definitions.—As used in this part, the term:
   14         (12) “Home health agency” means an organization that
   15  provides home health services and staffing services or an
   16  organization created for the purpose of advertising or promoting
   17  providers of home health services or services provided by a
   18  homemaker or companion as provided under part III of this
   19  chapter.
   20         (22) “Organization” means a corporation, government or
   21  governmental subdivision or agency, partnership or association,
   22  or any other legal or commercial entity, any of which involve
   23  more than one health care professional discipline; a health care
   24  professional and a home health aide or certified nursing
   25  assistant; more than one home health aide; more than one
   26  certified nursing assistant; or a home health aide and a
   27  certified nursing assistant; or an entity that advertises or
   28  promotes providers of home health services or services provided
   29  by a homemaker or companion as provided under part III of this
   30  chapter. The term does not include an entity that provides
   31  services using only volunteers or only individuals related by
   32  blood or marriage to the patient or client.
   33         Section 2. This act shall take effect July 1, 2017.
