    1                        A bill to be entitled                      
    2         An act relating to gratuity or service charges;
    3         amending s. 509.214, F.S.; requiring specified notice
    4         by a public food service establishment that includes a
    5         suggested gratuity or service charge in the price of a
    6         meal; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Section 509.214, Florida Statutes, is amended to
   11  read:
   12         509.214 Notification of automatic gratuity or service
   13  charge.—
   14         (1) Every public food service establishment that which
   15  includes an automatic gratuity or service charge in the price of
   16  the meal shall include on the food menu and on the face of the
   17  bill provided to the customer notice that an automatic gratuity
   18  or service charge is included.
   19         (2) Every public food service establishment that includes a
   20  suggested gratuity or service charge on the bill provided to the
   21  customer shall include on the face of the same bill a notice of
   22  the method for calculating the suggested gratuity or service
   23  charge. Such notice shall, at a minimum, advise the customer:
   24         (a) If the calculation was based on the pre-tax amount or
   25  the post-tax amount.
   26         (b) The percentage used to calculate the suggested gratuity
   27  or service charge, which was applied to the amount in paragraph
   28  (a) to calculate the suggested total shown on the bill.
   29         Section 2. This act shall take effect July 1, 2018.
