       The Committee on Health Policy (Young) recommended the
       following:
       
    1         Senate Amendment to Amendment (905618) 
    2  
    3         Delete lines 5 - 10
    4  and insert:
    5         (d) By October 3, 2017:
    6         1. Register all applicants that were denied dispensing
    7  organization licenses by the department under former s.
    8  381.986(1)(a), Florida Statutes 2014, if:
    9         a. The applicant filed a petition for an administrative
   10  hearing or appeal to challenge the department's denial of its
   11  application on or before March 1, 2017;
   12         b. The applicant's petition was pending as of March 1,
   13  2017; and
   14         c. The applicant meets the requirements of this section.

   16  For purposes of the requirement that an MMTC comply with the
   17  representations made in its application pursuant to subsection
   18  (7), an MMTC registered pursuant to this subparagraph shall
   19  continue to comply with the representations made in its
   20  application for approval as a dispensing organization, including
   21  any revision authorized by the department before the effective
   22  date of this act. After the effective date of this act, the
   23  department may grant variances from the representations made in
   24  a dispensing organization’s application for approval pursuant to
   25  subsection (7).
   26         2. Register five additional MMTCs with at least one of the
   27  MMTCs being an applicant that is a recognized class member of
   28  Pigford v. Glickman, 185 F.R.D. 82 (D.D.C. 1999), or In re Black
   29  Farmers Litig., 856 F. Supp. 2d 1 (D.D.C. 2011), and a member of
   30  the Black Farmers and Agriculturalists Association.
