    2         An act relating to hospice services; amending s.
    3         408.036, F.S.; exempting certain hospice services in a
    4         not-for-profit retirement community from specified
    5         review and application requirements; providing an
    6         effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Paragraph (a) of subsection (3) of section
   11  408.036, Florida Statutes, is amended to read:
   12         408.036 Projects subject to review; exemptions.—
   13         (3) EXEMPTIONS.—Upon request, the following projects are
   14  subject to exemption from the provisions of subsection (1):
   15         (a) For hospice services or for swing beds in a rural
   16  hospital, as defined in s. 395.602, in a number that does not
   17  exceed one-half of its licensed beds, or for hospice services in
   18  a not-for-profit retirement community that shares a controlling
   19  interest, as defined in s. 408.803(7), with a teaching nursing
   20  home, as defined in s. 430.80, and designated for a minimum of 5
   21  years.
   22         Section 2. This act shall take effect July 1, 2017.
