       Senator Rouson moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 620 - 640
    4  and insert:
    5         (a)The department shall issue electronic or physical
    6  medical marijuana use registry identification cards for
    7  qualified patients and caregivers who are residents of this
    8  state. The identification cards, which must be renewed annually,
    9  must be resistant to counterfeiting and tampering and must
   10  include, at a minimum, the following:
   11         1.The name, address, and date of birth of the qualified
   12  patient or caregiver.
   13         2.A full-face, passport-type, color photograph of the
   14  qualified patient or caregiver taken within the 90 days
   15  immediately preceding registration or the Florida driver license
   16  or Florida identification card photograph of the qualified
   17  patient or caregiver obtained directly from the Department of
   18  Highway Safety and Motor Vehicles.
   19         3.Identification as a qualified patient or a caregiver.
   20         4.The unique numeric identifier used for the qualified
   21  patient in the medical marijuana use registry.
   22         5.For a caregiver, the name and unique numeric identifier
   23  of the caregiver and the qualified patient or patients that the
   24  caregiver is assisting.
   25         6.The expiration date of the identification card.
   26         7. Compliance with the Health Insurance Portability and
   27  Accountability Act 1996 (HIPAA) as it pertains to protected
   28  health information and all other relevant state and federal
   29  privacy and security laws and regulations.
   30         8. For electronic patient and caregiver identification
   31  cards:
   32         a. Contain the technology to automatically expire and be
   33  remotely terminated by the department;
   34         b. Collect timestamped, geotagged data to be uploaded in
   35  real time into the compassionate use registry; and
   36         c.Maintain compatibility with smartphone and web-based
   37  platforms.
