       Senator Montford moved the following:
       
    1         Senate Amendment (with directory amendment)

    4  and insert:
    5         d. Notwithstanding the provisions of this subparagraph, a
    6  medical marijuana treatment center that holds an active,
    7  unrestrictive license to cultivate, process, transport, and
    8  dispense low-THC cannabis, medical cannabis, and cannabis
    9  delivery devices under former s.381.986, Florida Statutes 2016,
   10  before July 1, 2017, may establish dispensing facilities in
   11  excess of the maximum number allowed by this subparagraph,
   12  provided the additional dispensing facilities only dispense low
   13  THC cannabis, marijuana, and marijuana delivery devices to
   14  patients who are certified to suffer from a terminal condition
   15  or a physical medical condition that chronically produces
   16  symptoms or seizures or severe or persistent muscle spasms. For
   17  a dispensing facility that meets the provisions in this sub
   18  subparagraph to not be included in the maximum number of
   19  dispensing facilities allowed under this subparagraph, the
   20  medical marijuana treatment centers shall notify the department
   21  that the facility will only dispense low-THC cannabis,
   22  marijuana, and marijuana delivery devices to patients who are
   23  certified to suffer from a terminal condition or a physical
   24  medical condition that chronically produces symptoms or seizures
   25  or severe or persistent muscle spasms. The department shall
   26  include in the compassionate use registry selections for the
   27  physician to indicate whether low-THC cannabis, marijuana, or
   28  marijuana delivery devices are being ordered or recommended for
   29  a patient for one, one or more, or all of the following:
   30         (I)A physical medical condition that chronically produces
   31  symptoms or seizures or severe or persistent muscle spasms;
   32         (II)A terminal condition; or
   33         (III)A condition as provided for in s.29, Article X of the
   34  State Constitution.

   36  The department shall require physicians to certify on the
   37  compassionate use registry each and every medical condition
   38  selection applicable to the patient.
   39         e. This subparagraph shall expire on April 1, 2020.

   42  And the directory clause is amended as follows:
   43         Between lines 36 and 37
   44  insert:
   45         authorizing certain medical marijuana treatment
   46         centers to establish dispensing facilities in excess
   47         of a specified amount under certain circumstances;
   48         requiring a medical marijuana treatment center
   49         intending to establish dispensing facilities in excess
   50         of the maximum number allowed to notify the department
   51         of specified information; creating requirements for
   52         the department;
